Terms and Conditions / Consumer Protection

General Limitations

All terms of trading are governed by the laws of England and Wales. All parties are subject to the exclusive jurisdiction of the English courts. Without prejudice to statutory rights given to purchasers of products, the information and materials contained within this website, including without limitation, graphics, text and links, are provided to the best of our knowledge and ability and we cannot accept liability as to the truth, accuracy, or completeness of any product or service portrayed within. All products and services are subject to availability which may be withdrawn from sale to the public at any time. In such cases any customers will be offered an alternative or the option of a full refund. Prices are subject to change without notice at any time before formal acceptance. Products sold by CDS Electrics are suitable for installation and use on the UK mainland only and may not be suitable for use elsewhere. CDS Electrics has not provided any testing on products for safety, reliability, compliance, quality or function. Use of this website is at your own risk. No assurance is given as to it being free of errors, viruses, worms or other problems and CDS Electrics shall not be held liable for any damage that may be suffered as a result of such contamination or features. Goods remain the property of CDS Electrics until full payment has been received and processed through our bank.

Confirmation of Orders & Payment Details

  • Orders placed with CDS Electrics will be considered valid when placing the order by phone or through our online secure server. We do however reserve the right to cancel any order by phone email or letter and arrange for a full refund within one working day (Monday-Friday)in the rare situation of not being able to fulfil the order for whatever reason. Every effort of course is made to fulfil and deliver customer orders.

  • Payment may be made by credit card through our own card terminal at our sales office in the case of a telephone sale. The details on your card statement will show the sale registered to "CDS ELECTRICS" as agreed by our Bank. Alternatively payment may be made by cheque payable to CDS Electrics. In these cases the delivery of your goods may be delayed until the payment has been cleared by our bank.

Failure to Dispatch

Without prejudice to the statutory rights of customers under English law, CDS Electrics accepts no responsibility for failure of third-party manufacturers or their transportation agents to dispatch ordered goods whether to one of our warehouses or directly to our customers. Should such failure occur, or should CDS Electrics be unable to fulfill an order for any other reason, CDS Electrics undertake to inform the customer within 21 days of the order's acceptance. In such cases CDS Electrics will, as appropriate, provide either an immediate and full refund, or will not process the payment. The order will then be declared formally canceled. It is stressed that CDS Electrics can only take responsibility for delivery of stock to customers once appliances have been delivered from the manufacturer(s). Liability for late delivery is strictly limited to the total value of the goods concerned and cannot include any other related claims however caused.

Returns/Cancellation

We sell top quality appliances and as such do not expect problems with any of our products. All goods however are covered by at least one full years' parts and labour guarantee. Certain goods originating from Bosch, Hotpoint and Hoover as well as others may well carry additional cover. It is essential that every effort is made to identify any external marks or damage that could possibly have occoured due to transportation. In these cases customers are requested to refuse the delivery allowing the item to be returned for identfication and probable replacement. In any event, it is a condition of sale that such damage must be reported to us within three working days (Monday to Friday) giving us the opportunity to provide a satisfactory solution. We feel that this three day limit is a reasonable time for all our customers. Full details are available upon request. Any other problems encountered within 28 days of receipt can be solved by contacting us on main telephone number. We will then either arrange to collect the goods, exchange them or issue a refund.

Items sold on this website are as individual units and not as a linked transaction with other models. Items therefore cannot be rejected for example through one of a matching pair being substandard. We will ensure in this case that the offending machine is either repaired or replaced as soon as possible. If a fault is discovered after 28 days of receipt then we will arrange a service call or arrange a collection as is thought appropriate.

It is very important to note that it is always the customers responsibilty to ensure that adequate packaging is used as CDS Electrics will not accept responsibilty for damage caused by transportation back to ourselves. Products returned to us in a damaged condition (not caused by transportation) will either be returned at the customer's expense or sold at a reduced price. If this latter option is agreed then it follows that any refund must be witheld until the sale to the third party is made and the correct sum is then able to be calculated. We do require written, faxed or emailed confirmation that there is a problem with the appliance. Reliance on a telephone conversation is not sufficient. Returns of perfect goods may be returned within seven days of receiving them at the customers own expense for a full refund. In such cases it is conditional upon them being returned in their original packaging and must be unused. Larger white goods may well be subject to a re-stocking fee and be subject to the returns conditions relevant to that manufacturer. We feel CDS Electrics offers incredible value for money but common sense dictates that it is not good business practice to alter the agreed contract in changing or cancelling the sale through no fault of our own.

Please ensure that you take a note of a cancellation/returns number if the goods are not required before or after they have been scheduled to be delivered. This number will also act as official confirmation that the goods have been correctly designated as being returned to our warehouse and an authorised refund issued to enable funds to be sent back as soon as possible.

Please ensure that you are certain that the product ordered is exactly what is required. Give us a ring on our local call rate number to ask any relevant question. Details of each model is detailed on our site but cannot cover every detail. Please note that a redelivery charge is payable on all items ordered but later cancelled, refused or returned by the customer, to also include any delivery costs incurred by CDS Electrics for the return of that product. These sums can vary but are usually in the region of 20% of the price of the product and are not connected with the Free delivery included in the initial sale of the product. If the order can be cancelled before being entered onto our system then a small administration charge in the region of £10-15 will be made to cover our costs. When the item(s) has been paid for by a credit card then an additional 1.5% may be charged for each transaction processed.

Checking Your Goods/Inabilty for us to complete delivery.

Deliveries are undertaken by our own transport, by courier or by the manufacturer's own service to our customers. It is a delivery service that does not include connection or installation unless in our immediate area in most postcodes found in Outer London, Surrey , Sussex and parts of adjoining counties. Give us a ring to see if we can accomodate you in this respect at a very reasonable fee. Our promise of prompt delivery throughout England, Wales, and Scotland is not affected by size or weight but is offered on the basis of one delivery driver transporting the appliance from his vehicle to the front or rear door by way of a pallett truck or sack barrow. It is possible that larger appliances may need the assistance of an able-bodied person to ensure that the appliance is able to be placed over the threshold in a safe and secure manner. If applicable, we ask that arrangements for such assistance should be made for the agreed date of delivery. Please ask for further details if any clarification on this point is needed.

Deliveries are therefore normally restricted to:

  • Ground floor locations
  • Locations with easy access including front or rear steps

If there is likely to be a problem, please call us as we are sometimes able to authorise nonstandard deliveries if appropriate assistance is available, allowing deliveries to non-ground floor locations or to addresses where the size or weight of the machine may otherwise cause injury or damage to our driver or your property.

Full details can be given to you by telephone if there is any doubt as to this part of our service. Additionally, we will reiterate this information when we contact you with a firm date for delivery. Failure to inform us about likely problems may result in the item being left outside the delivery address at your risk, or returned to our warehouse for redelivery if the driver is experiencing great difficulty. In this instance we will need to charge a redelivery fee of approximately £25 to cover our costs.

  • IT IS VERY IMPORTANT that you check the appliance when delivered to you. We must be informed of any damage or shortage preferably on the day of delivery but at the very outside within three working days to allow us time to investigate and resolve the matter with the manufacturers or couriers. We will give every effort to resolve problems of this kind discovered after three working days of receipt but this usually will be restricted to repairing the appliance rather than arranging an automatic replacement.

  • IT IS ESSENTIAL TO ARRANGE FOR SOMEONE TO BE PRESENT AT THE DELIVERY ADDRESS TO ACCEPT THE APPLIANCES(S). If the delivery is unable to be completed through no fault of our own as a result of the customer or their representative being unavailable to accept the consignment on the date agreed, a charge will be made usually in the region of £25-£35 for each prearranged but failed delivery to partially offset our transportation costs. This sum must be settled before the delivery can be rearranged.

Our Privacy Policy

  • When you place an order or use a form on our website, we may need to know your name, contactable telephone number, postal and email address. By submitting this detail you consent to the use of this information in order to process your order or to action your request. The relevant information is then used by us, our agents and subcontractors to provide you with the service you have requested and to communicate with you on any matter relating to the provision of the service in general. The information you provide is not made available to any other people or organisations, and is kept secure at all times.

  • If at any time you wish to have your order information removed from our active databases, please send an email entitled "REMOVE FROM DATABASE" to remove@cds-electrics.com and we will take steps to ensure that the information is deleted as soon as is reasonably practicable.

Consumer Protection

For your protection, this website is intended to be fully compliant with the consumer protection (distance selling) regulations 2000. Customers can view and read about the features and benefits of items on sale from viewing the appropriate pages of this website. Please inform us if more information can be added. It is also confirmed that our customers will receive written confirmation of their purchase usually in the post within a few days of the sale. Also in line with the 2000 regulation customers have the right to cancel within a period of seven working days (Monday-Saturday)from the day of delivery. Written, faxed or emailed correspondence cancelling the sale must be received. Reliance on a telephone conversation is not sufficient. Please refer to your local trading standards office for full details of the regulations but briefly, items can be returned to us under this legislation if the post and packing is paid for by the customer. Confirmation of the appliance being in perfect condition by the courier company selected is required. Products returned to us in a damaged condition (not caused by transportation) will either be returned at the customer's expense or sold through one of our stores at a reduced price. If this latter option is agreed then it follows that any refund must be witheld until the sale to the third party is made and the correct sum is then able to be calculated. It is also mentioned that customers should retain the original packaging for the cooling-off period, to enable the item to be returned to us in saleable condition. These regulations only apply to unused goods. Electronic Commerce (EC Directive) Regulations 2002 CDS Electrics fully support all government legislation and wish to also include this further directive in our website which asks all website dealers to ensure certain information is included for all customers.

  • A reasonable description is to be found for each product sold along with full details of the price and any delivery charges payable. All items are shown inclusive of all VAT charges. Please advise us of any page that is lacking in detail so it can be amended.

  • Prices are current as shown on the day of sale although it is stressed that as our sales margins are very small making us a usually less expensive than most of our competitors, we do need to respond quickly to manufacturers' price alterations as well as other factors. This does mean our prices can vary upwards as well as downwards within any given month. It is guaranteed however that the price offered at the time will be that what is asked even if the price is later altered before delivery.

  • The contract is considered binding between ourselves and our customers when we have confirmed the sale either by email, the receipt by letter or verbal communication.

  • Information about the availabilty, delivery and despatch of the goods is the responsibility of our sales staff who are very keen to ensure that our customers receive their goods as quickly as possible.

  • It is occasionally regrettable that the manufacturers may experience difficulties in producing or delivering appliances to us within a reasonable period of time. Please do not hesitate to email or phone us to establish the current situation. If we are unable to fulfil the contract for this reason then we have no problem in refunding monies paid or offering an alternative. We are looking to you for repeat business so are eager to consider good customer relations as a priority.

  • Any complaints should be addressed prefereably in writing to: The Manager, at the address given at the bottom of this page. We will respond as quickly as possible.

  • CDS Electrics is a UK company and is therefore subject to the applicable law. Customers are reminded therefore that they are entering into a legally binding contract when purchasing goods from this website.
